Site Terms of Service Study Share for Recipients of Shared Data

1. Site Ownership and Operation:

The Alliance Medical Image Hub site (the “Site”) is owned and operated by Alliance Medical Diagnostic Imaging Limited (“we”).  We are registered in Ireland under company number 441778 and have our registered office at Portal House, Raheen Business Park, Raheen, Limerick, Ireland.

The Site allows users to retrieve, share and view diagnostic imagery on mobile devices/desktop.

2. Accepting the Terms:

By using the Site you confirm that you accept these terms of use and that you agree to comply with them.  If you do not agree to these terms, you must not use the Site.  We recommend that you print these terms for future reference.

THESE TERMS:

We may amend these terms from time to time.  Every time you wish to use our Site, please check these terms to ensure you understand the terms that apply at that time. 

3. We May Suspend or Withdraw Our Site:

We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted.  We may suspend or withdraw or restrict the availability of all or any part of the Site for business and operational reasons.  We will try to give you reasonable notice of any suspension or withdrawal. 

4. Site Access:

If you choose, or you are provided with, a user identification, password, or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. You are responsible for all usage or activity on Your Site account, including safekeeping of Your username and/or password and/or any other piece of information as part of our security procedures.  You shall not permit any third party to access the Site using Your username and/or password and/or any other piece of information as part of our security procedures.

You are responsible for any further processing of content which you view on our Site and you shall ensure that you comply with all data protection legislation in relation to such processing.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password you must promptly notify us at Imagehub@alliancemedical.ie

5. Personal Information and Data:

We will only use your personal information as set out in our Privacy Policy.

6. Intellectual Property:

We are the owner and licensee of all intellectual property rights in the Site and in the material published on the Site including the diagnostic images.  Those works are protected by copyright laws and treaties around the world.  All such rights are reserved. 

You must not use any part of the content on our Site for commercial purposes without obtaining a licence to do so from us or our licensors.

7. Licence of Software:

Alliance Medical gives you a revocable, personal, non-assignable and non-exclusive licence to use the Site provided to you by Alliance Medical.

You may not (and may not permit anyone else to) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Software or any part thereof, unless this is expressly permitted or required by law, or unless you have been specifically authorised to do so in writing by Alliance Medical.

8. Liability:

We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

To the maximum extent permitted by applicable law, Alliance Medical shall not be liable for any direct, indirect or consequential loss or damage however caused whether authorised or not and regardless of the theory of liability, whether in contract, tort (including negligence) or otherwise for loss or damage arising out of or related to: (a) the use of, or the inability to use, the Site ; or (b) unauthorized access to or alteration of Your transmissions or data, even if Alliance Medical has been advised of the possibility of such loss or damage. In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

You have sole responsibility for adequate protection and backup of data and/or equipment used in connection with the Site and will not make a claim against Alliance Medical for lost data resulting from Your use of the Site. In particular You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to access the Site and to permit You to obtain and properly view the Diagnostic Imagery Results. You shall be solely responsible for any loss of data or damage to Your computer system resulting from your use of the Site. For the avoidance of doubt, nothing in this Agreement excludes or limits our liability for death or personal injury caused by our negligence or for our fraud or fraudulent misrepresentation.

We do not guarantee that the Site will be secure or free from bugs or viruses.  You are responsible for configuring your information technology, computer programmes and platforms to access our Site.  You should use your own virus protection software. 

You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is maliciously or technically harmful.  You must not attempt to gain unauthorised access to the Site the server on which the Site is stored or any server, computer or database connected to the Site.  You must not attack our Site via denial of server attack or distributed denial of server attack.

9. Governing Law:

The Site has been designed to comply with the laws of Ireland. Use of the Site is subject to the laws of Ireland which shall exclusively govern the interpretation, application, and effect of this Agreement. The courts of Ireland shall have exclusive jurisdiction over all claims or disputes arising in relation to, out of, or in connection with this agreement, the Site and Your use of the Site.

10. General:

This agreement constitutes the entire agreement between Alliance Medical and You with respect to Your use of the Site.

If any provision of this agreement shall be held unlawful, void or unenforceable for any reason then such provision shall be deemed severed and shall not affect the validity and enforceability of the remaining provisions.
